    摘要:

    高校人事制度改革后,外聘教师管理仍有待进一步完善。文章在肯定高校外聘教师工作取得一定成绩的同时,指出了许多高校在外聘教师管理过程中出现的问题。高校与外聘教师之间签订的合同属于劳动合同,对外聘教师的管理应该在《劳动合同法》及相关劳动法律法规的指导下进行规范。这样可以促进学校自主用人,维护学校和外聘教师双方的合法权益。

    Abstract:

    Recently,termination of the employment contract between Wuhan University and seriously ill Professor Zhang Zaiyuan was publicized in the media and aroused hot discussion.This event exposed that the management of teachers recruited from outside has yet to be further improved after the reform of university personnel system.Affirming the fact that university teachers recruited from outside definitely made certain achievements,this paper indicates the problems in the management of teachers recruited from outside in many universities.The contracts between universities and teachers recruited from outside are labor contracts and the management of teachers recruited from outside should be normalized under the guidance of Labor Contract Law and relevant labor laws and regulations.This can promote independent employment of universities,maintain the legitimate rights and interests of universities and teachers recruited from outside.
