Abstract:The Civil Code of the People's Republic of China will enter into force on January 1, 2021, and China will soon enter the era of civil code. "The prosperity of the code, the prosperity of the country will be." Based on the civil Code, other laws and regulations, judicial interpretation, and relevant regulations of the department, this paper analyzes and discusses related problems in China's real estate industry, focusing on the issues of the expropriation and compensation of houses on state-owned land, the transfer of the right to use construction land, and the realization of the mortgage and security right of buildings under construction. Combined with the provisions of laws, regulations and rules and the practical practice, this paper discusses the matters needing attention and the prevention of risks in the operation of the real estate industry, and highlights the regulatory role of laws in the healthy development of China's real estate industry.
