Abstract:The addition of relevant provisions to the revised Law on Administrative Penalty has eased the awkward situation in which there is no specific legal basis for the disclosure of administrative penalties. However, this disclosure system usually leads to the imbalance among different parties, in particular, the conflict between disclosure of penalty decisions and protection of personal information. Such a problem mainly lies in the incoherent system connection and the out-of-date legal provisions. Accordingly, from the perspective of system construction, this paper, taking personal information protection into accounts, probes into the effective solutions to some realistic problems, such as the conflict of powers, the contradiction of rights, and the disadvantages of the rules, in the system of administrative penalty decision disclosure. Also, this paper, with the purpose of protecting personal information rights of the counterpart, sets individualized disclosure decision standards via introducing principle of proportionality, so that the conflict between the administrative penalty disclosure and personal information protection can be resolved.
